OREEZA Terms of Service

Account Eligibility: You must be able to enter into a binding agreement in your jurisdiction to use the Services. If you create an account, you agree to provide accurate information and to keep your credentials secure.

Account Responsibility: You are responsible for activity that occurs under your account, unless you notify us of unauthorized use in line with any instructions we provide.

Electronic Communications: By creating an account or using the Services, you consent to receive communications from OREEZA electronically, including by email, website notices, or other electronic means. You agree that such communications satisfy any legal requirement that communications be in writing.

Platform Function: OREEZA provides a platform to discover and learn about experiences and related offerings. We may change, suspend, or discontinue features of the Services with reasonable notice when practicable.

Age Requirements: Users must be at least 18 years old to create an account or make a booking.

Participation of Minors: Minors may participate in experiences only when accompanied by a parent, legal guardian, or other responsible adult, subject to any host requirements.

Logistics, Taxes, and Documentation

Travel Documentation & Entry Requirements: Travelers are solely responsible for verifying and obtaining all valid passports, visas, insurance policies, health certificates, vaccinations, and entry permits required for the destination country and specific local communities. OREEZA is not liable for any cancellations, delays, border denials, or financial losses resulting from a traveler's failure to meet these entry requirements.

Local Tax & Regulatory Compliance: Depending on the jurisdiction of the host or experience, your booking may be subject to local taxes, tourism levies, or community fees. While OREEZA attempts to display these transparently at checkout, travelers are ultimately responsible for paying any legally mandated local fees required on-the-ground that cannot be collected in advance by the platform.

Listings and Pricing: Listings, availability, and pricing are provided by hosts and community partners and may change without notice.

Booking Terms: Applicable host–guest terms, cancellation policies, and refund policies will be displayed at the time of booking and form part of the agreement between the traveler and the host.

Refund Policies: Refund eligibility, timing, and processing may vary depending on the applicable host cancellation policy and payment provider requirements.

Payouts, Disputes, and Currencies

Payout Schedule and Financial Controls: OREEZA will hold funds received as a limited payment collection agent on behalf of the Host and agrees to remit the Host's share, which consists of the booking amount minus OREEZA's host platform commission, applicable Service Fees, and any third-party transaction processing fees, according to OREEZA's standard payout schedule, which typically initiates payouts after the scheduled cultural experience or stay has commenced.

Withholding for Disputes and Chargebacks: Hosts explicitly authorize OREEZA to withhold, delay, or deduct amounts from payouts to cover traveler refunds, active disputes, fraudulent activity, or chargeback fees initiated by banks or credit card issuers.

Currency Conversion & International Fees: All transactions are processed in U.S. Dollars (USD) unless explicitly stated otherwise at checkout. If you pay using a non-USD credit card or bank account, your financial institution may apply currency conversion rates and international transaction fees. OREEZA is not responsible for, and will not refund or compensate for, any variations in price resulting from foreign exchange fluctuations or fees imposed by your bank.

Chargebacks & Payment Disputes: If you initiate a chargeback or dispute a payment through your credit card issuer or bank without first attempting to resolve the issue directly with OREEZA or the host, OREEZA reserves the right to temporarily or permanently suspend your account. In the event of an unjustified chargeback, you agree to reimburse OREEZA for the full amount of the chargeback plus any administrative fees incurred by us in disputing the claim.

Payment Processing: Payment processing services for bookings are provided by third-party payment processors. OREEZA is not liable for errors, failures, or security breaches resulting from third-party payment processing. By making a booking, you also agree to be bound by the terms and privacy policies of our third-party payment processors.

Appointment of OREEZA as Limited Payment Collection Agent: Each Host and Community Partner hereby appoints OREEZA as its limited payment collection agent solely for the purpose of accepting, receiving, and processing funds from travelers on behalf of the Host.

Satisfaction of Traveler Payment Obligation: When a traveler pays the total booking amount to OREEZA, the traveler's payment obligation to the Host for that booking is completely satisfied and extinguished. The Host has no legal right to demand payment from the traveler directly, regardless of whether OREEZA has yet remitted the funds to the Host. In the event that OREEZA does not remit any such payments to a Host, that Host will have recourse only against OREEZA, and not against the traveler.

Platform Service Fees and Host Commissions: OREEZA reserves the right to charge travelers a non-refundable platform service fee, booking fee, or administrative fee ("Service Fees") in exchange for providing the Services and marketplace infrastructure. These Service Fees will be displayed clearly to travelers at checkout and belong entirely to OREEZA.

Third-Party Terms: By initiating a booking, you acknowledge that payment processing services are bound by the separate terms of service and privacy policies of our third-party payment processors, which you agree to review and accept as a condition of completing your transaction.

Marketplace Role: OREEZA acts solely as a marketplace platform that facilitates connections between travelers and hosts. Hosts and community partners are independent providers and are solely responsible for the experiences, accommodations, transportation, and services they offer.

Limitation of Services: Unless expressly stated otherwise, OREEZA is not a travel agency, tour operator, transportation provider, accommodation provider, or insurer. OREEZA's role is limited to providing the Services and facilitating connections between travelers and hosts.

Third-Party Information: While OREEZA strives to present accurate information, hosts and community partners are responsible for the accuracy of their listings, descriptions, availability, pricing, and other content. OREEZA does not guarantee the completeness or accuracy of information provided by third parties.

Cross-Border Compliance & Sanctions: Users represent and warrant that they are not citizens of, or located within, any country subject to U.S. trade sanctions or embargoes. OREEZA reserves the right to immediately cancel bookings, freeze funds, and terminate accounts if required to do so by international banking regulations or government compliance laws.

Important Note on Schedule Flexibility: Because experiences occur within authentic local communities, itineraries and scheduled activities may occasionally shift dynamically or be cancelled entirely to respect local community needs, seasonal agricultural practices, unexpected cultural ceremonies, bereavement periods, or regional community protocols.

Hosts reserve the right to modify or completely cancel an experience at any time, including on short notice, to preserve community integrity, safety, local tradition, or respect.

In the event of a complete cancellation by the host, the traveler will be refunded their paid OREEZA booking fee. However, OREEZA and the host are not responsible or liable for any secondary or external expenses the traveler has already paid, including but not limited to airline flight tickets, train or transit fares, separate hotel accommodations, visa fees, or travel insurance. Such culturally driven modifications or cancellations do not constitute a breach of contract and do not entitle the traveler to any additional compensation.

Incubation Disclaimer: To assist local hosts and community partners in transitioning to a digital marketplace, OREEZA may temporarily assist with creating listings, translating content, uploading photography, or facilitating communications on behalf of a host or community.

Operational Liability: You explicitly acknowledge and agree that such administrative or technical assistance does not constitute OREEZA acting as the host, co-host, operator, or manager of the experience. The host or community partner remains 100% legally liable for the accuracy of the listing, the safety on the ground, and the fulfillment of the service. OREEZA's clerical assistance is provided solely to bridge technology gaps and does not shift any operational liability or duty of care to OREEZA.

Independent Partner Status: NGOs, non-profits, community coordinators, and local organizations (collectively, "Community Partners") who onboard, train, manage, or list experiences on behalf of local hosts do so as completely independent contractors. Community Partners are not employees, agents, joint ventures, or partners of OREEZA.

Onboarding and Safety Vetting: Community Partners and Hosts represent and warrant that all listed experiences are vetted for basic safety, accurate representation, and alignment with local laws or indigenous community protocols. Community Partners assume full responsibility for ensuring that the local hosts they represent understand the booking requirements, arrival schedules, and safety considerations of confirmed travelers.

Funds Distribution and Local Compensation: Where a Community Partner or NGO acts as a financial intermediary (receiving payouts from OREEZA to distribute to local indigenous or rural hosts), that Community Partner assumes total, absolute liability for the timely, fair, and accurate distribution of those funds to the rightful local providers. OREEZA disclaims all liability for internal community financial disputes, wage claims, or misappropriation of payouts once the funds have been successfully transferred to the designated Community Partner account.

Cultural and Environmental Stewardship: Community Partners and Hosts agree to conduct all experiences in a manner that prevents the exploitation of local traditions, protects intellectual property rights of indigenous communities, and minimizes environmental impact. OREEZA reserves the right to immediately de-platform any Host or Community Partner found to be engaging in coercive, exploitative, unsafe, or deceptive practices.

Mutual Indemnification: Community Partners and Hosts agree to indemnify, defend, and hold harmless OREEZA from any claims, damages, liabilities, or expenses (including legal fees) arising out of injuries, property damage, or contractual failures occurring during an experience they onboarded or managed.

Traveler Responsibility: Travelers are responsible for determining whether they are physically, medically, and otherwise able to participate in an experience. Certain experiences may involve physical activity, high-altitude environments, remote locations, weather exposure, transportation challenges, or other conditions that may not be suitable for all individuals. Travelers should consult appropriate medical or professional advice where necessary before participating.

Inherent Risks: Participation in experiences involves inherent risks, including injury, illness, property damage, transportation delays, weather conditions, and other unforeseen events. Travelers voluntarily assume these risks. OREEZA is not responsible for, and disclaims all liability for, any incidents, accidents, injuries, illnesses, property damage, losses, or delays that may occur during an experience or stay.

Environmental and High-Altitude Risks: Certain experiences offered on the platform take place in geographically demanding environments, including high-altitude regions, remote terrain far from immediate medical facilities, or areas subject to unpredictable, volatile weather.

Travelers are entirely responsible for assessing their own physical readiness, medical vulnerabilities, and acclimatization needs. You voluntarily and completely assume all physical, medical, and psychological risks associated with traveling to and participating in these remote or high-altitude environments.

Force Majeure: OREEZA is not liable for delays, cancellations, service interruptions, or changes to experiences caused by events beyond our reasonable control, including but not limited to weather conditions, natural disasters, strikes, civil unrest, transportation disruptions, government actions, public health events, or infrastructure failures.

Indemnification: You agree to indemnify and hold harmless OREEZA from claims arising out of your use of the Services, your violation of these Terms, or your interaction with hosts, communities, or third parties.

Prohibited Conduct: You agree not to misuse the Services, for example, by attempting to access non-public areas, interfering with security, scraping in violation of our policies, harassing others, or using the Services for unlawful purposes.

Investigation and Action: We may investigate and take appropriate action, including removing content or restricting access, if we believe conduct violates these Terms or harms users, hosts, communities, or OREEZA.

No Commercial Resale or Arbitrage: The Services are provided exclusively for personal, non-commercial use. You may not purchase experiences, stays, tours, or tickets through OREEZA for the purpose of commercial resale, distribution, speculative booking, or price arbitrage. OREEZA reserves the right to immediately cancel any bookings suspected of violating this provision without liability or obligation to refund.

Cultural Respect: Travelers agree to respect local customs, cultural practices, property, and community guidelines. OREEZA may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, harmed other users or communities, or engaged in unlawful, fraudulent, abusive, or unsafe conduct.

Community-Led Support: OREEZA exists to support community-led cultural tourism. Users agree to engage respectfully with hosts, traditions, cultural knowledge, ceremonies, and community spaces. Content or conduct that exploits, misrepresents, or disrespects communities may result in suspension or removal from the platform.

Proprietary Rights: The Services, OREEZA branding, and related content (excluding user- or host-provided materials) are owned by OREEZA or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use unless otherwise agreed in writing.

User Content License: By submitting content to OREEZA, you grant OREEZA a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and promote such content in connection with the Services.

Review Integrity & Content Removal: Any reviews, photos, or feedback you submit must be truthful, accurate, and based entirely on your genuine personal experience. OREEZA reserves the absolute right, in its sole discretion and without prior notice, to remove, edit, or block any user content that we deem fraudulent, defamatory, malicious, or intended as a means of extortion or leverage against a host.

Expectation Warning: You acknowledge that OREEZA specializes in facilitating access to authentic, community-led, and often rural or remote cultural experiences. These offerings take place in living, working communities and natural environments. They do not conform to standardized western hospitality, resort-style, or commercial luxury metrics.

By booking, you explicitly accept that accommodations, plumbing, electrical infrastructure, heating, transportation, internet connectivity, and physical accessibility may be highly rustic, inconsistent, or rudimentary compared to standard commercial tourism infrastructure. OREEZA and its hosts disclaim all liability for discomfort, minor logistical disruptions, or inconveniences stemming from the rustic nature of these environments.

"As Is" Status: The Services are provided “as is” and “as available.” To the fullest extent permitted by law, OREEZA disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising from course of dealing or usage.

Community Realities: Experiences take place in real communities; conditions, logistics, and third-party services are outside our full control. You are responsible for your own travel decisions and for respecting local norms and host guidance.

Damages Exclusion: To the fullest extent permitted by applicable law, OREEZA and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services.

Liability Cap: Our aggregate liability for claims relating to the Services is limited to the greater of (a) the amount you paid to OREEZA for the Services giving rise to the claim in the twelve months before the claim, or (b) one hundred U.S. dollars (US$100), except where prohibited by law.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict-of-law principles, except to the extent that applicable consumer protection laws in your jurisdiction provide otherwise.

Dispute Resolution & Binding Arbitration: You and OREEZA agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Services, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable arbitration rules.

Venue & Class Action Waiver: The arbitration shall take place in the State of New Jersey, USA, unless otherwise required by applicable law. You acknowledge and agree that you and OREEZA are each waiving the right to a trial by jury and the right to participate as a plaintiff or class member in any purported class action, class arbitration, or representative proceeding. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, except where prohibited by applicable law.

Severability & Waivers: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. OREEZA’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right.
